Fifth Amendment


Running a red light is a criminal matter as outlined under section 544.007(d) of the Texas Transportation Code.  The City Ordinance 3017 sec 3.(k).(iii) states “failure to contest is an admission of liability”, in direct violation of Fifth Amendment rights to due process.  In a criminal matter a citizen can not be compelled to testify.  A unwillingness to testify is not an admission of guilt rather a recognition that the State must bring evidence to convict.  Neither the State, nor the Courts would allow this to stand in a criminal matter, and by using  ordnance 3017 College Station, TX is establishing a second class citizen.  The first that has Fifth Amendment rights and the second that has no rights under the Fifth Amendment.
